84 Lumber Faces Lawsuit for Wrongful Termination

According to the West Virginia Record, 84 Lumber is facing a wrongful termination lawsuit filed by a former employee in Cabell Circuit Court. 84 Lumber is a building material supplier to contractors and homeowners.

Kevin Waugh claims he had injured himself during the course of his employment and filed a Workers’ Compensation claim. Waugh claims he received temporary total disability benefits for an injury that occurred in August 2008. In 2009, Waugh received a letter from 84 Lumber relieving him of his employment duties and stating the company had terminated his employment.

Waugh claims in his lawsuit that the company fired him from employment because of his injury claim and not because of any legitimate employment reason.

According to the lawsuit, 84 Lumber violated the West Virginia Human Rights Act by terminating employment of an injured individual. Waugh is seeking compensatory and punitive damages along with pre and post judgment interest.
