Why Is This Former LA Radio Announcer Suing for Wrongful Termination?

Are you a victim of discrimination? The former announcer for K-Love 107.5, a Spanish radio station in Los Angeles, is suing her former employer over allegations she was fired for having a medical condition. According to the suit filed against Univision, the former announcer lost her job after receiving treatment for a benign stomach tumor.

The former announcer’s doctor informed her there was a possibility the tumor could become cancerous. According to the lawsuit, she told Univision that she would require surgery.

The woman argued that 107.5 had consistently high ratings during the 15 years she worked at the station. Univision allegedly fired the woman for tardiness, arguing she had missed multiple shifts without cause. The media conglomerate also claims she could have scheduled her medical appointments outside of work hours, and that she had not requested accommodations or medical leave.

Can You Be Fired for Having a Medical Condition?

Depending on the situation, the Americans With Disabilities Act may protect workers from being fired for a medical condition. Workers undergoing treatment for health conditions that qualify as a disability may have legal options to hold employers accountable for wrongful termination.

In addition, workers may have protections under the Family Medical Leave Act and California Family Rights Act. There may also be options for partially-paid medical leave under the California Paid Family Leave/Temporary Disability Insurance program. Workers who utilize this program might be able to receive six weeks of partial wages.

By gathering available evidence and contacting an employment law attorney, workers terminated for taking medical leave can discover legal options.
