An employee, referred to as “Moore,” was terminated for using prescription medical marijuana, may have a legitimate claim to his wrongful termination lawsuit. It is a shame that Moore was not given the benefit of the doubt here. A long-term employee was fired simply for using a substance he was prescribed and that is legal in the state of California.
Even though Moore is an at-will employee, his termination was not related to his actions or job performance. Moore claims he never used his prescribed medical marijuana before or during work hours. Moore was an ambitious dedicated employee who managed to climb the corporate ladder in two years. Why was Moore terminated when the company policy allows for the use of medical marijuana for employees who have a prescription? It seems that this employer will have to explain its logic in terminating Moore or it may lose this lawsuit.
