A former partner is suing Kleiner Perkins Caufield & Byers, a Silicon Valley venture firm, for gender discrimination and retaliation. Ellen Pao sued the firm in San Francisco Superior Court in May 2012 for gender discrimination and filed an amended complaint in October 2013 claiming she was retaliated against for the lawsuit and terminated. Kleiner filed a response to Pao’s amended complaint in November stating that she was terminated for “longstanding performance issues,” not for filing the original lawsuit.
Pao still claims that she was maliciously terminated and her claim against Kleiner is now in the discovery phase as both sides provide evidence to each other. Pao claims that she experienced harassment and retaliation at Kleiner from 2006 up until her termination. Kleiner denies her claims and states that the firm was unaware of her complaints until early 2012 when she had already hired a lawyer to file the suit. Pao is seeking compensation for lost future and back pay, lost carried interest in Kleiner’s investment funds and punitive damages.
Gender discrimination is considered a form of sex discrimination under California law even if the discrimination is not sexual in nature. Discrimination based upon gender at any stage of employment is illegal, though proving it is not always easy. It is also a violation of federal law to retaliate against an employee who reports discrimination.
