Most cases settle before court. Again, the employer has certain risks, that in the time and expense of litigation they could be hit with a large jury verdict. In the labor and employment sphere, often many of the statutes that regulate employee-employer relations also allow for the attorneys, the prevailing employee’s attorney to make a fee application and so, therefore, even after we get a verdict, we can apply under certain statutes to get additional attorneys fees paid and the employer often has to pay that also.
